Welcome to EveryScribe, an advanced AI-powered audio and video transcription service. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

EveryScribe provides users with a platform to convert audio and video files into highly accurate text using online and offline speech recognition models. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations. You are solely responsible for the media you upload and transcribe.

Account and Subscription

1. Account Registration: To access certain features (including the Unlimited tier), you must create an account providing accurate information.
2. Account Security: You are responsible for maintaining the confidentiality of your credentials. Sharing accounts between multiple individuals is strictly prohibited.
3. Fair Use Policy: Our "Unlimited" subscription is designed to easily accommodate the transcription needs of a single individual professional or creator. It is not intended for shared or team accounts, automated systems, or institutional-scale bulk processing. We reserve the right to rate-limit, pause, or suspend accounts that exhibit abusive usage patterns that negatively impact the experience of other users.

Data Privacy and Security

We take your privacy seriously. EveryScribe offers a Secure Offline Mode, allowing you to process files entirely on your local device.

• When using the Offline Mode, your audio and transcripts never leave your computer.
• When using our Online Models, your files are processed securely on our servers and are automatically deleted after processing. We do not use your audio or transcripts to train our AI models.

Prohibited Activities

While using EveryScribe, you agree not to:

• Share your account or subscription credentials with others.
• Reverse engineer, decompile, or attempt to extract the source code or local AI models of the service.
• Transcribe illicit, illegal, or non-consensual recordings that violate local laws.
• Interfere with or disrupt the security, performance, or availability of the service.
• Attempt to automate or scrape the service using bots or undocumented APIs.

Pricing and Refunds

• Billing: Subscriptions are billed on a recurring basis based on your selected plan.
• Cancellations: You may cancel your subscription at any time. Your access to premium features will continue until the end of your current billing period.
• Refunds: Due to the immediate and high cost of providing GPU-accelerated AI computation, all purchases are generally final and non-refundable, unless otherwise required by law.

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. While we strive for the highest transcription accuracy (often 99%+), we make no warranties or representations about the absolute accuracy, reliability, or flawless availability of the service.

Limitation of Liability

To the fullest extent permitted by law, EveryScribe and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service, including but not limited to loss of data or loss of profit.

Indemnification

You agree to indemnify and hold harmless EveryScribe, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these Terms.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.
